Terms of Service

3.1 Account Creation

You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.2 Account Security

• Use a strong, unique password
• Do not share your login credentials
• Enable additional security features when available
• Log out from shared devices

4.1 You agree NOT to:

• Harass, bully, threaten, or intimidate other users
• Post content that is illegal, harmful, or offensive
• Impersonate others or misrepresent your identity
• Spam, advertise, or engage in commercial solicitation without permission
• Share malware, viruses, or malicious code
• Attempt to hack, exploit, or compromise our systems
• Scrape, collect, or harvest user data
• Circumvent bans or suspensions
• Create multiple accounts to evade restrictions
• Engage in any activity that violates applicable laws

4.2 Prohibited Content

You may not post content that:

• Contains hate speech or promotes discrimination
• Depicts or promotes violence or self-harm
• Contains sexually explicit material involving minors
• Infringes on intellectual property rights
• Contains personal information of others without consent
• Is fraudulent, deceptive, or misleading
• Promotes illegal activities

5.1 Your Content

You retain ownership of content you create and post on Konverse. By posting content, you grant Konverse a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the service.

5.2 Our Content

Konverse and its logos, designs, and features are owned by Konverse Labs. You may not copy, modify, or distribute our intellectual property without permission.

5.3 User-Generated Content

• You are solely responsible for content you post
• We do not endorse user-generated content
• We may remove content that violates these Terms
• We may retain copies of removed content for legal compliance

6.1 Our Rights

We reserve the right to:

• Remove or restrict content that violates these Terms
• Suspend or terminate accounts for violations
• Report illegal activities to law enforcement
• Cooperate with legal investigations
• Modify or discontinue features at any time

6.2 Enforcement Actions

Violations may result in:

• Content removal
• Warnings
• Temporary suspension
• Permanent account termination
• Legal action where appropriate

6.3 Appeals

If you believe an action was taken in error, contact support@konverse.app with details. We will review appeals but are not obligated to reverse decisions.

9.1 "AS IS" Service

Konverse is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free service

9.2 No Guarantee

We do not guarantee:

• The accuracy or reliability of any content
• That the service will meet your requirements
• That the service will be available at all times
• The security of data transmission

10.1

Konverse and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of profits or revenue
• Loss of data
• Loss of goodwill
• Personal injury or emotional distress

10.2

Our total liability for any claims arising from these Terms or your use of Konverse shall not exceed the greater of:

• The amount you paid us in the past 12 months, or
• $100 USD

12.1 Informal Resolution

Before filing a formal dispute, contact us at support@konverse.app. We will attempt to resolve the issue informally within 30 days.

12.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

12.3 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that you may bring claims in small claims court if eligible.

12.4 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

14.1 By You

You may terminate your account at any time through account settings or by contacting support@konverse.app.

14.2 By Us

We may suspend or terminate your account:

• For violations of these Terms
• For extended inactivity
• If required by law
• At our discretion with reasonable notice

14.3 Effect of Termination

Upon termination:

• Your right to use Konverse ends immediately
• We may delete your account data (subject to legal retention requirements)
• Provisions that should survive termination will remain in effect

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Konverse.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.
